General Terms and Conditions (AGB) of Custom Car Parts (customcarparts.ch)

  1. Scope
    These General Terms and Conditions (AGB) apply to all orders placed through the website customcarparts.ch. The offer is exclusively aimed at consumers residing in Switzerland (hereinafter referred to as "Customer").

A consumer is a natural person who enters into business relationships with Custom Car Parts without being related to their commercial or self-employed professional activity. Orders in quantities not typical for household use can be refused without reason.

Custom Car Parts reserves the right to change the AGB at any time. The version valid at the time of the order is decisive. Conflicting or deviating terms of the customer will not be recognized.

  1. Information on the Website
    Custom Car Parts provides information about products and services. Price and product range changes, as well as technical adjustments, are reserved. All information on customcarparts.ch (product descriptions, images, illustrations, technical specifications, accessory information, etc.) serves for illustration purposes and is non-binding. They do not represent guaranteed characteristics or warranties unless explicitly stated.

All offers on this website are non-binding. Custom Car Parts strives to provide correct and current information, but cannot guarantee the completeness or correctness.

Availability and delivery times may vary at any time without notice and are non-binding.

  1. Prices
    All prices indicated are final prices in Swiss Francs (CHF) and include statutory VAT and any other legal charges unless otherwise stated.

Changes, errors, and printing mistakes in prices are reserved. Consulting and support services are included in the price.

  1. Conclusion of Contract
    The products and prices presented on customcarparts.ch are non-binding.
    By ordering on the website and accepting the AGB, the customer makes a legally binding offer. Upon receipt of the order, the customer will receive a confirmation email.
    The contract is concluded as soon as Custom Car Parts confirms the order by email and announces the shipment. Orders will only be shipped after full payment has been received (except for delivery on account).

If a product is unavailable, the customer will be informed. Any payments made will be refunded or the customer will be relieved of the payment obligation.

  1. Payment Methods and Retention of Title
    The payment methods specified during the order process are available. Custom Car Parts reserves the right to exclude customers from certain payment methods or insist on advance payment.

Products remain the property of Custom Car Parts until full payment is made. In case of delayed payment, interest of 5% per year and reminder fees of up to CHF 20.- per reminder may be charged.

  1. Delivery, Duty to Inspect, and Returns
    Delivery is made by post or courier service to the address provided by the customer. Delivery times are non-binding, and partial deliveries are possible.

The customer is obligated to inspect the goods immediately upon receipt for defects and report them in writing via email to support@customcarparts.ch. Returns are at the customer's expense and risk and must be in original packaging with all accessories.

If an inspection reveals that the goods are not defective, Custom Car Parts reserves the right to charge the customer for any inconvenience.

  1. Right of Withdrawal
    The customer has the right to cancel the order in writing within 14 calendar days. The period begins upon receipt of the goods.

Returns must be made within 10 days, in original packaging, and complete. The customer is responsible for return shipping costs. Payments made will be refunded within 20 days.

The right of withdrawal does not apply to:

  • Products custom-made to customer specifications.
  • Products that cannot be returned for hygiene reasons.
  • Services that have already been fully provided.
  1. Warranty
    Custom Car Parts guarantees the products' defect-free condition for the statutory warranty period of two years from the delivery date. The warranty covers repairs, replacements, or refunds.

The warranty does not cover:

  • Normal wear and tear.
  • Damage due to improper use.
  • Consumable parts such as batteries.
  1. Liability
    Custom Car Parts excludes any liability for direct or indirect damages, as far as legally permissible. This includes consequential damages and loss of profit.

  2. Data Protection
    Custom Car Parts processes customer data in accordance with applicable data protection regulations. For more information, please refer to the privacy policy on customcarparts.ch/datenschutz.

  3. Jurisdiction and Applicable Law
    Only Swiss law applies. Jurisdiction is Bern or the customer's place of residence.
